Welcome to sanfranciscomarijuanacard.org (the "Site"), operated by San Francisco Marijuana Card ("we," "us," or "our"). By accessing or using the Site or booking an evaluation, you agree to these Terms & Conditions ("Terms"). If you do not agree, please do not use the Site.
1. Eligibility
- You must be at least 18 years of age and a California resident with valid government-issued identification.
- Medical marijuana recommendations are issued only to patients whom a licensed California physician determines have a qualifying condition under California Health & Safety Code §11362.5.
2. Nature of Services
We provide a telehealth platform that connects patients with independent, California-licensed physicians for medical marijuana evaluations. The decision to issue a recommendation rests solely with the evaluating physician based on their professional medical judgment. We do not guarantee approval, and we do not sell, distribute, or dispense cannabis in any form.
3. Appointments, Fees & Pay-After-Approval Policy
- No payment is collected when you book an appointment.
- You are charged only after a physician approves your medical marijuana recommendation. If you are not approved, you owe nothing.
- Approved recommendations are typically issued within 10–15 minutes of the completed evaluation; delivery times are estimates, not guarantees.
- Current pricing is published on our Pricing page and may change with notice on the Site.
- Because fees are charged only after a recommendation is approved and delivered, all completed-evaluation fees are non-refundable.
4. Telehealth Consent
By booking an evaluation, you consent to receive healthcare services via telehealth and acknowledge that telehealth has limitations compared to in-person care. You agree to provide accurate, complete, and truthful information about your identity and health history. Providing false information may void your recommendation.
5. Patient Responsibilities
- Use your recommendation only as permitted by California law.
- Do not transport cannabis across state lines or onto federal property; cannabis remains illegal under federal law.
- Do not drive or operate machinery while impaired.
- Keep your recommendation current; renewals are required every 12 months.
6. Intellectual Property
All content on the Site — text, design, graphics, and logos — is owned by or licensed to us and protected by applicable intellectual-property laws. You may not reproduce or distribute Site content without our prior written consent.
7. Third-Party Services
The Site may link to or embed third-party services, including our scheduling platform. We are not responsible for the content, policies, or practices of third-party services.
8. Disclaimers
The Site and its content are provided "as is" without warranties of any kind, express or implied. Nothing on the Site constitutes medical advice; see our Medical Disclaimer. We do not warrant that the Site will be uninterrupted, error-free, or secure.
9. Limitation of Liability
To the maximum extent permitted by law, San Francisco Marijuana Card and its officers, physicians, and contractors shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or services. Our total liability for any claim shall not exceed the amount you paid for the evaluation giving rise to the claim.
10. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your misuse of the Site, violation of these Terms, or violation of any law or third-party right.
11. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in San Francisco County, California.
12. Changes to These Terms
We may revise these Terms at any time by posting an updated version on this page. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
